Session Policies, Terms, and Copyright
Booking: To secure your booking, a non-refundable session deposit is required. Please note that session dates are only confirmed upon receipt of the deposit. By booking a session with Tianas Creations Photography, you acknowledge and agree to abide by the terms and policies outlined on this page, irrespective of the payment method used
Print Release: Sessions include photographer's full personal print release with your digital images.
Online Gallery: Your online gallery will be available within 10-14 days following your session. This gallery will remain accessible for viewing and ordering purposes for a duration of 10 days.
Personal photos: cameras, cell phone cameras, and camcorders are not permitted to be used in our studio or during any session.
Notice of Legal Copyright: Tianas Creations retains the copyright to all images indefinitely. Unauthorized use of images, including on this site, Facebook, or any other platform, for commercial, professional, sale, competition, or promotional purposes is strictly prohibited without our explicit permission. This includes, but is not limited to, props, products, or client likeness. Violations may result in fines starting at $150,000, as per Copyright Law. Tianas Creations reserves the right to publish images from your session for social media, website, promotional, editorial, trade, and other lawful purposes. Please contact Tiana directly before booking if you are interested in purchasing the copyright.
Do Not Copy: Please refrain from copying, screenshotting, downloading, or saving any photos from our Facebook, Instagram, website, or gallery. If you order digital files, you will receive copies specifically edited for social media. All portrait orders, whether print, product, or digital, are final. Prints may not be copied, scanned, or reproduced. Digital image packages will include the photographer's print release along with suggested printing labs.
Newborn Baby's Arrival and Session Date: It is the client's responsibility to notify Tianas Creations Photography within 24 hours of the baby's birth to secure a session within the 5-10 day timeframe. Failure to do so may result in the forfeiture of all payments made. Additionally, clients must complete the newborn information form within 4 days of birth to ensure proper session preparation. Failure to provide this information will result in session cancellation without refund or rescheduling options.
Please note that all sessions are private, and only those being photographed are permitted in the studio. Older siblings, extended family, friends, and nannies are not allowed to attend unless they are part of the session.
Session Arrival: For baby sessions, please arrive at least 5 minutes before your scheduled time. Newborn clients should arrive on time to ensure there's enough time for feeding if needed at the session starts on time. Please be aware that there are no refunds for late arrivals if you’re more than 10 minutes late.
Session Times: Newborn sessions are scheduled Monday through Friday, starting promptly at 10 am. Clients are requested to arrive punctually. The duration of newborn sessions varies according to your package, lasting up to 1-3 hours. Baby sessions are also conducted on Mondays through Fridays and are strictly by appointment only. The photographer reserves the right to conclude the session earlier if all desired shots are captured.
Sickness: If you or your child, or anyone in your household, is unwell, kindly give at least 24 hours notice before the scheduled session. While emergencies may arise, failure to provide notification of absence without a phone call will result in forfeiture of all fees paid. Clients who arrive more than 30 minutes late or fail to attend or cancel without notice will also forfeit all payments made.
Working with Babies and Posing: Results from sessions may vary, including the number of poses and shots captured. Working with babies and infants offers no guarantees, as each child has a unique personality and may perform or pose differently. Your baby's comfort is our primary concern, and they will never be placed in a position or pose that is uncomfortable for them. Newborns who are fussy, for any reason, may require additional soothing time, resulting in fewer shots taken and fewer images produced. Babies with jaundice may be especially fussy. Clients who do not adhere to session preparation tips may find that their babies are less likely to be sleepy during the session. We strongly recommend reading and following the session preparation guidelines provided.
The optimal time for newborn photography is typically between 5 to 16 days after birth. Babies older than 16 days may not sleep as soundly, may require more feeding, and may be less cooperative for posing. If you choose to schedule your newborn session after 18 days and your baby is fussy or awake, awake shots will be taken, potentially resulting in fewer images. Posing may be adjusted at any time to accommodate the baby's comfort and session constraints.
In rare cases where the gallery does not contain the expected number of images due to reasons such as stranger anxiety or separation anxiety, refunds will not be provided. Additionally, if the session is disrupted due to factors like a fussy or uncooperative baby, late arrival, or uncooperative siblings, refunds will not be offered even if the gallery is incomplete.
Family and Older Siblings: Newborn and baby sessions are dedicated solely to capturing your baby's precious moments. To maintain a calm, safe, and distraction-free environment during the 2-3 hour session, older siblings/children are not allowed in the studio unless they are part of the session. While we offer newborn session packages that include a few parent and sibling shots, the focus remains on your baby. Extended family is not included in newborn sessions, and sibling shots are only available in certain packages. The success of sibling shots depends on the cooperation of older children.
For safety reasons, sibling shots with toddlers are created as composite images. It's common for toddlers to be unsettled around a new sibling, so composite shots ensure your newborn's safety and reduce stress for parents. Additionally, attempting shots with a toddler can be time-consuming and may detract from the newborn session.
Creative License: The photographer will make all final decisions regarding session styling, props, colors, blankets, and accessories, tailoring them to suit the style and preferences of the client. While the photographer's expertise guides these decisions, client preferences will be taken into careful consideration to ensure a personalized experience. Any specific requests should be communicated prior to booking. The selection of images for your gallery will be made by the photographer, and each image will be personally hand-edited by Tiana. Editing is an integral part of the artistic process and cannot be reversed once finalized. Additional edits beyond the initial ones will incur a fee of $45 per edit per image. Please note that raw, unedited images are not available for viewing or purchase.
Products: All sales are considered final, including digital images, packages, prints, birth announcements, custom USBs, albums, and wall art, which are non-refundable. Once an order is placed, it cannot be altered or canceled. For albums and birth announcements, designs are created by Tiana, and previews or edits are not provided to the client. Please note that prints or products produced by outside labs are not guaranteed in terms of color, contrast, or quality, as these factors can vary significantly. Additionally, album layouts may entail slight cropping of images to fit the design.
Payment:
Session Packages must be paid in full prior to the session date. As your due date approaches, you'll receive an invoice for the remaining balance, which can be conveniently paid online. Failure to settle the invoice by the session date will result in cancellation of the session and forfeiture of the deposit.
For Baby Sessions, full payment is due after finalizing the gallery and image selection. Last-minute bookings require full payment at the time of booking. Once booked, sessions are guaranteed at the quoted price, though pricing may change without prior notice.
Please note that deposits and session packages are non-refundable, as they cover significant preparation, studio, and photographer's time. Re-shoots are not available, and pricing is fixed. Refunds are not provided, but session credit is valid for one year from the original booking date.
Rescheduling & Cancellations:
In order to accommodate booked studio time and extensive preparation, a 72-hour notice is required for rescheduling. Cancellations made on the day of the session or no-shows will result in forfeiture of all payments made, with no refunds provided under any circumstances. If the studio cancels your session, alternative session options will be offered, possibly including a different type of session based on your baby's age.
Illness: Please inform us if your child has experienced any illness within ten days leading up to your session. The well-being of the newborns in our studio is our top priority, and Tiana cannot risk exposure to a sick child. If your child is unwell or displaying symptoms such as a cold, we kindly request a 48-hour notice to reschedule the session and avoid a rescheduling fee. Sick children will not be permitted in the studio, and regrettably, they will be turned away if they arrive for their session while ill. Please note that a rescheduling fee of $300 will be applied, which also extends to any other household member attending the session.
Waiver of liability:
The client hereby releases Tiana's Creations Photography and its staff from any claims, damages, or liabilities arising from incidents that occur during the portrait session or while on the premises. This waiver of liability encompasses all claims, and the client agrees to indemnify and hold Tiana's Creations Photography harmless for any damage to personal property during the session.
Backup: The client is responsible for backing up their digital files. Galleries will be accessible for 10 days for viewing and selection, with a $50 fee for reloading the gallery. Dropbox links for image download will be valid for 5 days, and a $50 fee applies for a new link after expiration. While efforts are made to retain images for one year, faulty backups can happen. Digital files are only available for one year, and it's advised to save them on a desktop computer to prevent image loss and compression that may occur when downloading to phones or tablets. TCP is not liable for any compression resulting from downloading to mobile devices.
Vendors: I am deeply committed to protecting the privacy and dignity of my young clients and their images. It is strictly prohibited to copy, download, screenshot, or utilize any images from this website or social media for promotional or advertising purposes, including clients sharing images on their own social media. This policy is firm and non-negotiable. These precious individuals are not to be treated as props for product promotion. Please don't hesitate to reach out if you have any inquiries. Tiana's Creations Photography retains the right to decline service to any individual.
Currently, I do not entertain third-party bookings. Only the client (baby's parents) are permitted to consent to a session. Sessions arranged with contracts signed by a third party will lead to forfeiture of all payments made and cancellation of the session. This policy is non-negotiable, and no exceptions will be made.
VAPE or E-CIGARETTES
are not permitted inside the studio.
