The session agreement is put into place so you know exactly what a session with me entails and to ensure that I am able to deliver on your expectations.
Please read all information carefully, print a copy for your records, and then provide your signature.

THE SESSION


1) To reserve the Session Date, Client shall pay to Photographer, upon execution of this Agreement, a non-refundable retainer fee in the amount of $150 (for regular sessions) or $300 for newborn sessions. Client understands and agrees that Photographer will not book other sessions during this time. In the event that Client cancels the portrait session or fails to attend the session on the Session Date, for any reason, Photographer shall suffer losses that are difficult to ascertain. As such, Client agrees that, in the event of cancellation by Client, such $150 or $300 whichever the amount was paid, shall be forfeited by Client and paid to Photographer as liquidated damages and not as a penalty. Client and Photographer agree that such amount is reasonable.
 2) The non-refundable retainer fee reserves your session date and time. Your session date must be scheduled within 30 days of paying the retainer fee, but not necessarily held within that time. If you do not schedule a date, then the retainer fee is forfeited. You may reschedule your session once w/o penalty, giving at least 48 hrs. notice (see holiday sessions below for special circumstances) new date must be held within 15 days of original date.
Due to the enormous preparation, studio and photographer’s time, retainer and session packages are non-refundable and pricing is non-negotiable.
Payment: Session Packages are due in full prior to your session date/due date or when baby is born (whichever comes first). As your session date/due date approaches, you will be invoiced for your session balance. Invoices not paid by their session/due date or when baby arrives (whichever comes first) will result in cancellation of your session and forfeit of your retainer.
Baby Sessions are due in full one day prior to your session date. Sessions booked within one week of due date or session are considered last minute; last minute booking session fees are due in full at the time of the session.
3) Credits and pricing expire 30 days after the images are delivered.
4) You are responsible for covering additional fees and costs related to location choice (admission fees, parking, etc.). Travel up to 20 miles round-trip from 91356 is included. Time and travel above this will be invoiced at $4/mi.
5) Because it can be distracting (especially to small children) and prevents me from being able to do my job effectively, other cameras are not allowed at the photo session (with the understandable exception of births). 
Rescheduling & Re-shoots
6) Requests for rescheduling are granted only at my discretion. If someone becomes ill, please email or call as soon as possible to reschedule. You may reschedule your session once w/o penalty, giving at least 48 hrs notice (see holiday sessions below for special circumstances). New date must be held within 15 days of original date.
I maintain the right to reschedule if needed due to inclement weather, illness, emergency, etc.
After a second request to reschedule or if the session is not held within 15 days of original session date, the retainer fee is forfeited and current pricing will apply to the new session.
7) Unless there is an emergency situation or bad weather, we cannot reschedule sessions during the peak holiday season. If you have to reschedule a session originally set to be held anytime between Sept. 1 through Dec. 15, the initial retainer fee will be forfeited and you will need to pay it again.
8) No shows – If I show up to your session and you are more than 1-hr late or do not show at all, the retainer fee is forfeited. If you wish to reschedule your session after this, you will need to pay the retainer fee again.
9) Partial re-shoots are granted only at my discretion.
10) The final session fee is due a week before the session or at the session; the fee can be paid with any major credit card, cash or check.
11) The best images from the session will be uploaded to a private gallery within 10 days of your session, at that time you can choose your images. As soon as you give me your selection I will edit the images and contact you when your gallery is complete. Please allow 2-3 weeks for delivery, I will notify you as soon as your images are ready.

12) Creative privilege – there are times when an image needs a certain crop or a particular treatment. I maintain the freedom to decide how to make an image look its absolute best.
13) There is a $100 minimum for printing orders & current pricing applies.
14) UNPURCHASED FILES ARE PURGED FROM MY SYSTEM 90 DAYS AFTER THE SESSION DATE.

15) Some images (particularly those shot in low light) may have visible digital noise when enlarged too much. This is normal, but may not be aesthetic.
In addition, if you crop an image in too tightly, you will lose resolution and may cause it to be pixilated when enlarged. To ensure the best print quality, try to avoid altering your images before printing. If in doubt, just ask me. I am not responsible for printing errors or for quality of prints or products not printed directly by me.
16) Tiana Creation Photography retains copyrights on all images (even those purchased). With the signed model release, Tiana Creation Photography reserves the right to use the images and/or reproductions for display, publication, or other purposes.
17) Under no circumstances can a client use images for commercial purposes, profit, or photographic competition or display. Re-editing or applying any filters to the images is not allowed.
18) Please do not copy images you have not purchased.
Copying, printing, screenshots, or scanning images from your online gallery, my website, the blog, or from other materials is considered stealing, regardless of the intent for use.
  Design Work
19) If you purchase items that require design work (birth announcements, cards, albums, etc.…), I will consult you first to get your input on the images, colors, text, etc. Try to be as specific as possible because I base my design work off of your requests. I will then create a design doing my best to incorporate your requests. You can make up to three small changes to that design (change a color, change text, change out a picture).
Additional changes (including changing things that were originally requested by you) will be billed at $60/hr. Once the requested changes are made, charges apply regardless if the final product is purchased. 
20) Since a book/album is a larger design, you can make changes on up to 5 pages at no charge; additional changes will be billed as previously described. Try to keep in mind that there is a great deal of time and planning that goes into the layout, so adding, deleting, or moving pictures around can be quite complicated and may affect several pages of the overall design.

21) Once you approve a design and tell me to print, any additional changes will be at your cost.
OTHER
22) Checks returned by the bank for any reason will be charged a $25.00 service charge and sessions/orders will be cancelled if they are not paid in full within three days of notification.

23) Credits and special offers are non-transferable and are not redeemable for cash.
24) Tiana Creation Photography, LLC does not offer free or discounted re-shoots on the basis of client regret over wardrobe choice, location choice, or other conditions out of the photographer’s control.
25) ALL SALES ARE FINAL.


REMINDER: With the exception of births, other photography or recordings are prohibited at the session. Please be sure everyone is aware of this before the session.
·Limitation of Liability
I hereby waive, disclaim and release Tiana Creation Photography, LLC and its respective owners, members, employees, agents, volunteers and representatives (the “PTP Parties”) from any and all actions, claims or demands that I may have now or in the future, whether known or unknown, against the PTP Parties, including without limitation those related to injury to or death of persons, or damage, loss or destruction of property arising out of or in connection with the Session or any products related thereto.
·Indemnification
I hereby agree to indemnify and hold harmless the PTP Parties from all liabilities, losses, claims, costs (including attorney’s fees and court costs), damages or expenses of whatever nature that may result from injury to or death of persons, or damage, loss or destruction of property arising out of or in connection with the Session or any products related thereto.
